Businessman Andrew John Laird White has petitioned the Director of Public Prosecutions Keriako Tobiko to reinstate conspiracy to murder charges against politician Betty Tett.
This is after he allegedly obtained telephone data linking her to the main suspect in the case.
White has written to Tobiko through lawyer Paul Mwangi seeking a review of his decision not to prefer charges of conspiracy to murder against Tett and John Wachira.
“I have been instructed that there is pending before you a request of the reopening of investigations and review of decision not to prefer charges of conspiracy to murder on one John Linus Wachira together with Betty Tett, in respect of our client Andrew John Laird White. I wish to review the application and to restate it as follows,” the lawyer’s letter dated January 16 states.
The lawyer argues that the Directorate of Criminal Investigation’s recommendation to drop the conspiracy to murder charges was based on an incompetent investigation and perverted analysis of evidence and witnesses.
Tett’s son, David William Tett, who is serving a life sentence at the Kamiti Maximum Security Prison, has recanted his earlier statement which was relied on by the DPP to terminate the conspiracy to murder charges against Tett and her alleged co-conspirator Wachira. Wachira was arrested after allegedly trying to kill White in 2014 and is also in Kamiti for a separate case.
White claims to have obtained from private investigators records of Tett and Wachira, which show they were in contact in 2013.
The lawyer has presented the DPP with four box files of phone records together with a soft copy on disk.
“On the basis of these new developments also, my client seeks a review of your decision to drop the conspiracy to murder charges against Betty Tett.”
He wants a re-investigation of the phone records by a new and independent team.
In January 2015, David William Tett wrote a statement from the Kamiti Prison, discrediting the testimony of Wachira that implicated his mother.
Wachira was the hit man allegedly employed by Tett to kill White, who she considered a business rival. David’s testimony that Wachira was just a conman and not a killer caused the case against his mother to collapse.
In March last year, David denounced his previous statement in an affidavit sworn for White’s legal team. He says he only wrote the statement after his mother promised to use her political connections to have him released from jail.
His latest affidavit says that he believes both Wachira and Tett are capable of murder.
White used to be the Creative Director of Scanad, East Africa’s largest advertising agency. He retired in 2013 and set up a production company called Fat Rain Film to make radio and TV adverts.
Previously, Tett’s production company Supersonic Sound created adverts for Nairobi advertising agencies but in 2014, her expatriate manager quit to join White.
